Terms of Service

1. Acceptance
By accessing or using any PortraitDesk product — including portraitdesk.com, HeadshotQueue, Volunteer Media Hub, EventShot, and Lumière — you agree to be bound by these Terms of Service. If you do not agree, do not use our services.
2. Who We Are

3. Our Services
PortraitDesk provides software tools for professional photographers and organisations:
- HeadshotQueue — a SaaS headshot session management platform available at headshotqueue.com.
- Volunteer Media Hub — a self-hosted white-label media platform for volunteer organisations.
- EventShot — a self-hosted event photo sales platform.
- Lumière — a self-hosted white-label client gallery delivery platform.
Self-hosted products (VMH, EventShot, Lumière) are licensed to you as software. HeadshotQueue is provided as a subscription service.
4. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at info@portraitdesk.com of any unauthorised use. You may not share or transfer your account without our written consent.
5. Acceptable Use
You agree not to:
- Upload content that infringes third-party intellectual property rights or contains unlawful, abusive, or defamatory material
- Upload photos of individuals who have not given appropriate consent, or of minors without verifiable parental consent
- Attempt to reverse-engineer, decompile, or extract source code from our software
- Circumvent any technical access controls, rate limits, or security measures
- Use our services to send spam or unsolicited communications
- Use our services in any way that violates applicable law or regulation
You are solely responsible for ensuring that your use of our platform — including the personal data of your own clients that you upload or collect — complies with the laws of the jurisdictions in which you and your clients are located.
6. Intellectual Property
Photos uploaded to PortraitDesk platforms remain the copyright of the original photographer. By uploading content, you grant PortraitDesk a limited, non-exclusive, royalty-free licence to store and serve that content solely to operate the service. We make no claim to ownership of your work.
The PortraitDesk platform software, design, and trademarks are the property of TimmiStudio di VD. You may not reproduce, distribute, or create derivative works without our written permission.
7. Payments and Refunds
Paid subscriptions (HeadshotQueue Pro) are billed in advance for a set period. All payments are processed securely by Stripe. We do not store card details. Refunds are handled on a case-by-case basis — contact us at info@portraitdesk.com within 7 days of a charge if you believe an error has occurred.
Self-hosted product licences are one-time purchases and are non-refundable once the licence has been delivered.
8. Service Availability
We aim for high availability of HeadshotQueue but do not guarantee uninterrupted service. We will provide reasonable notice of planned maintenance where possible. We are not liable for losses resulting from service interruptions, including data loss, missed bookings, or business disruption.
9. Data and Privacy
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You are responsible for ensuring you have the appropriate legal basis to collect and process your clients' personal data through our platform.
10. Termination
We may suspend or terminate your account for material breach of these Terms, with or without prior notice depending on severity. You may cancel your account at any time. Upon termination, your data will be retained for the grace period defined in your plan, then deleted in accordance with our Privacy Policy.
11. Limitation of Liability
To the fullest extent permitted by applicable law, PortraitDesk shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the service. Our total aggregate liability shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Governing Law
These Terms are governed by the laws of Italy and, where applicable, the European Union. Any disputes shall be subject to the exclusive jurisdiction of the Italian courts, without prejudice to your rights as a consumer under the laws of your country of residence.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you by email of material changes. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
